Because the Lands Resumption Ordinance/Railways Ordinance compensate only for actual loss and the tribunal found a reasonable businessman would have continued trading, the claimant's cessation produced only hypothetical loss which was not compensable; the claimant failed to discharge the burden of proof on factual evidence (accounts, HTL records, paving ownership), so the appeal is dismissed.
