The court held that Seacliff had established necessity sufficient to invoke Norwich Pharmacal and Bankers Trust exceptions: discovery against Decca limited to documents directly evidencing its contracts, quotations, invoices and receipts (items 1–4) was justified to identify and quantify misappropriation, but speculative requests for any payments made by Decca back to named entities (proposed item 5) were refused as insufficiently founded; discovery against Credit Lyonnais was ordered for tracing on Bankers Trust principles. Costs orders were made accordingly.
