On the pleaded facts, which are deemed admitted by the defendants failure to file a defence, the plaintiff established goodwill in its trade name, defendants company names amount to a misrepresentation likely to cause public confusion, and the plaintiff will suffer damage; accordingly the court granted injunctions restraining defendants from using the impugned names and awarded costs to the plaintiff.
