The Court held the Detention Centre order was wrong in principle for large-scale commercial trafficking of herbal cannabis and substituted a custodial sentence because the gravity of the offence, the quantity involved, the respondent's role, prior offending while on bail and triad connections warranted immediate imprisonment; the court adopted a 4‑year starting point (consistent with guidelines), reduced by one third for guilty plea to 3 years, and substituted 2 years 9 months imprisonment after accounting for about 5 months already served in a Detention Centre.
