There existed genuine disputes of fact and law as to whether requisitions on title had been fully answered, whether the licence transfer was a condition precedent and whether delays were attributable to the purchaser; those disputes required a full trial and could not be resolved on a summary judgment application under Order 14, therefore the defendant was granted unconditional leave to defend and the plaintiff's summary relief was refused, subject to the defendant undertaking to pay $250,000 into court within seven days.
