The Court dismissed both appeals: the Secretary for Justice's decision to seek transfer to the District Court was not Wednesbury-unreasonable given consideration of factors (notably likely sentence and absence of any peculiar feature making District Court unfair), and the second judicial review was an abuse of process because the constitutional challenge to section 88 could and should have been raised in the earlier judicial review and was in substance a collateral challenge, so leave to pursue the second review was properly refused.
