The Court held the prosecution never alleged senior management were co-conspirators so no amendment was warranted and the applicant suffered no prejudice; there was no evidential basis that translation failings affected the fairness of the trial and the applicant's decision not to testify was properly left to the jury with standard directions; the convictions were safe; accordingly leave to appeal and the appeal were refused and a loss of time order of 2 months under s83W(1) CPO was imposed.
