Leave to appeal was granted because the Defendant demonstrated at least an arguable case on the principal issues: (1) unexplained conduct by the Plaintiff in seeking eviction raises a triable issue whether eviction would defeat the mutual will and attract a constructive trust, and (2) the adequacy of the notice period and whether a post-death licence existed are triable issues affecting trespass damages.
