The appellate court held that there was insufficient reliable evidence to conclude the second statement was voluntary given the possibility of a subsisting threat about one hour earlier and no proof that any threat had been lifted; the third gratuitous confession was admitted without proper canvassing and may also have been tainted; in those circumstances the conviction was unsafe and had to be quashed.
