Security for costs was refused because the 6th and 7th Defendants are at least equal attackers — their counterclaim arises from the same invoices and issues and will be fully litigated anyway — and because the defendants provided no satisfactory explanation for their lengthy delay which has caused real prejudice to the plaintiff; on that basis the court exercised its discretion to dismiss the appeal and refuse security.
