Where a corporate trustee has been dissolved and cannot discharge its duties and restoration is impracticable, the court will appoint a fit and proper judicial trustee under s63 Trustee Ordinance to prevent the trust failing; the court may dispense with service and may waive Judicial Trustee Rules requirements (statement and security) where assets are ascertained and there is no prejudice and the nominated trustee is fit and proper.
