Given the historical documentary ambiguity, the failure to trace or locate the alleged trustee, the absence of evidence of any subsisting trust interest or vesting by the trustee in a beneficiary, and the applicants' need to clear title for development, the court exercised its discretion under s45 of the Trustee Ordinance to remove the trusteeship of Tang Ching Shi and vest the properties in the applicants; accordingly the originating summons as amended was granted ex parte.
