The Court refused to extend time because the applicant's Notice of Motion was about two weeks late with no explanation and the intended appeal raised no question of great general or public importance and was unarguable, making an extension futile under its discretion in Cap.484 ss.24(5)-(6).

The appeal was without reasonable prospect of success; under s13 the court may order costs to the prosecution and under s15(a) such costs must be compensatory. The court assessed 7.5 reasonable hours at HK$3,900 per hour and ordered the appellant to pay HK$29,250, disallowing additional preparatory time of the substitute prosecutor beyond 1.5 hours of hearing attendance.
