The Deputy Commissioner lawfully exercised his broad statutory discretion to form an independent view of the evidence without receiving further representations, there was no reversal of burden of proof or material procedural unfairness in the adjudicating officer's process, the inferences drawn were legitimate on the evidence, and the dismissal was within the Commissioner’s disciplinary discretion; therefore the judicial review application to quash the decision fails.
