Although there is a serious issue to be tried on whether Clause 15.3 affords the 1st Defendant a complete contractual defence to the Plaintiff's claim, damages are an adequate remedy and the balance of convenience strongly favors permitting the 1st Defendant to debit the Plaintiff's account; accordingly the Plaintiff's summons to continue the injunction against the 1st Defendant is dismissed and costs are awarded to the 1st Defendant.
