The convictions were quashed because the prosecution failed to prove essential elements: Mr Wong's conviction was unsafe as the finding of possession was speculative, and the Company's conviction failed because there was no finding or evidence that the Company was conducting a business of retail sale of poisons or dispensing/compounding/manufacturing drugs as required by section 20(1).
