The court found on the balance of probabilities that Chan Tin Nam failed to prove he was the lawful and natural son of the deceased, that the deceased possessed testamentary capacity when she executed the 10 September 1990 will, and that she knew and approved its contents; accordingly the will is valid, the plaintiff's intestacy claim fails, the Letters of Administration are revoked and probate of the will is granted.
