- Court
- Court of Appeal
- Case number
- CACC688/1997
The court upheld conviction because the three limbs of recent possession were satisfied: stolen items were positively identified and found in the applicant's possession within hours of the burglary, and the applicant's explanations were wholly incredible; accordingly the inference of guilty knowledge was justified and the conviction was safe. The three-year sentence for burglary and one-year consecutive sentence for unlawful remaining were appropriate.
