The court held there was no error in the magistrate's application of sentencing principles; the magistrate properly applied the totality principle by ordering counts (1)–(4) to run concurrently and count (6) to run consecutively resulting in a total effective sentence of five months, which was not manifestly excessive, and therefore dismissed the appeal.

The sentencing judge correctly balanced the appellant's youth and mitigation against the gravity of unlicensed and uninsured driving on a major expressway; custodial detention at a labour training centre and a 12‑month driving disqualification were proportionate and not manifestly excessive, therefore the appeal is dismissed.

Because the 1st appellant had once been permitted to drive in Hong Kong on his UK licence under Regulation 37 and had never been disqualified, the past-tense proviso in the policy ('has held and is not disqualified from holding or obtaining such a licence') encompassed him; the Magistrate erred in requiring the licence to be one issued by the Hong Kong authority, and therefore the convictions for using a vehicle without third party insurance (and permitting its use) were quashed.

The magistrate lawfully concluded the breach of the disqualification order was flagrant and there were no exceptional or mitigating factors to justify a non-custodial sentence; therefore the custodial sentences were appropriate and not manifestly excessive, and the appeal is dismissed.
