On the balance of probabilities the judge preferred Warburton's evidence over Stewart's, found that the oral agreement existed on the terms Warburton described, found Stewart's words and subsequent conduct amounted to dismissal of Warburton, and concluded Warburton's retention of the US$ in a safety deposit box and immediate seeking of legal advice did not constitute dishonest conversion; therefore judgment was entered for Warburton.
