The court held that absent evidence demonstrating political interference, mala fides or extreme irrationality in prosecutorial decision-making, courts will not interfere; the applicant's evidence did not establish such exceptional circumstances or an arguable case that the employer had forged documents to evade liability, therefore the refusal of leave to apply for judicial review was correctly upheld and the appeal dismissed.
