Where a vessel lacks life‑saving equipment, firefighting appliances and navigation lights and is operated at night to carry unauthorized entrants, the offence is as serious as operating an unseaworthy vessel; an appropriate starting point was seven years, but a two‑year discount for the guilty plea and one month credit for immigration custody reduced the sentence to four years and eleven months.
