The Court held that the first sentence (assisting passage) with a five-year starting point plus a two-year uplift for an unseaworthy and dangerously operated vessel was appropriate; the second sentence (endangering safety at sea) merited the maximum starting point but the defendant was entitled to the full one-third guilty plea discount, reducing that sentence to two years and eight months; the two sentences should run consecutively given prior identical convictions and the dangerous conduct, producing a total effective sentence of seven years and four months.
