The Court of Appeal held that the magistrate was entitled to disbelieve the appellants' explanations and to find beyond reasonable doubt that the television sets were not for crew personal use but intended for smuggling; accordingly the convictions were upheld and the Bill of Rights argument did not alter that outcome, and s94A did not need to be relied upon to sustain the convictions.
