The Court allowed the appeal because the trial judge's finding of negligence against the 1st Defendant was unsustainable: the accepted speed evidence was unreliable and inconsistent with stopping distances, and the stationary fodder lorry obstructed the driver's view so that he could not reasonably have seen the child in time to avoid the collision; on those facts the driver could not be held negligent as a matter of law.
