The court was satisfied on the evidence in the related criminal proceedings that the 11 items were used in the commission of offences and, in the absence of admissible evidence from respondents showing they took sufficient steps to prevent such use, there was no basis to exercise the discretion to return the items; accordingly the items were forfeited and costs were awarded and apportioned one-third per vehicle among the claimants.
