Judge found on credibility that defendant did promise the sculpture surface feature and therefore breached and was guilty of negligent misrepresentation; nevertheless the plaintiff accepted and executed the 11 July 1988 settlement which amounted to a full and final compromise and estopped the plaintiff from pursuing the original claims; plaintiff accepted compensation for one set and retained/leased the other with a free Gerber system, therefore no basis for claim of total loss and damages were dismissed.
