Bail refused because applicant failed to show very good prospects of success on appeal; the trial judge's factual findings and credibility assessments were supported by evidence and not plainly untenable; and even if some grounds succeeded any reduction in sentence would not be substantial enough to make continued detention unjust.

The 7.5 month sentence was not manifestly excessive because the offences involved breach of trust, planning and forgery warranting a deterrent sentence, and the magistrate reasonably reduced a 15 month starting point by half for guilty pleas and restitution.

The Court held the appropriate aggregate starting point for the applicant's combined offending was five years, applied the one-third discount for guilty pleas to reach 3 years 4 months (40 months), and varied the concurrency order by directing that 18 months of the sentences in DCCC388/98 run concurrently with those in DCCC312/98 to produce that aggregate sentence; the sentencing judge erred by not stating starting points.

The Court held the trial judge rightly admitted the cautioned statement as voluntary, correctly treated and warned himself about accomplice evidence, and was entitled to prefer the prosecution's evidence; there was ample evidence to establish knowledge and concerted use of the forged cards, so the conviction was neither unsafe nor unsatisfactory and the appeal is dismissed.
