The Court held that the Magistrate's sentencing decision was within appropriate limits: given conviction after trial the starting point was about 22 months, the Magistrate's sentence of 20 months for the identity offence and 3 months for theft (ordered to run concurrently) properly applied the totality principle and there was no sufficient mitigation to justify interference; appeal dismissed.
