On the pleadings the Plaintiff established a case that the Notice of Severance was procured or executed when the Mother lacked sufficient mental capacity, supported by contemporaneous guardianship proceedings and undisclosed medical material; the court exercised its discretion under Order 19 r7 to enter judgment without a trial and declared the Notice invalid and ordered the memorial vacated, with costs ordered nisi to be paid from the estate.
