On the available contemporaneous correspondence, signature comparison, the conduct of creditors and liquidators, and police and land search evidence, the court concluded the Plaintiffs did not execute the Guarantee and the document was forged; a forged instrument is void and could not affect the Property, and therefore the court, exercising its inherent jurisdiction, ordered the registration vacated; the Registrar was properly named because rights of the dissolved Pro Finance vested in the Government under s.752(1).
