Validation orders for DIL and DJL were refused because the Receivers' evidence demonstrated that DIL (and by extension DJL) appeared insolvent such that paying employee petitioners in full would improperly prefer them over other creditors; however, there was a clear prima facie case and need for investigation, so the Receivers were appointed provisional liquidators of DIL, DJL and Checkers and winding up orders for all three companies were made.
