The court held that Article 8 of Macau Ordinance No.5/2004 does not apply to the casino credit agreement and does not render it void or oust Hong Kong jurisdiction; clauses in the Agreement did not establish an exclusive Macau forum; Macau was not clearly or distinctly the more appropriate forum; consequently there was no real or sustainable defence and summary judgment was ordered for the plaintiff for HK$7,350,000 with contractual interest.
