Because the deceased died before 7 October 1971 s.62(1) P&A Ordinance did not apply and no statutory trust for sale arose; therefore the estate was administered under common law where a sole administratrix could sell land and give a good discharge; alternatively, if acting as trustee the trustee's written receipt under s.15(1) Cap.29 would be sufficient. Consequently the 1975 assignment passed good title and the sole administratrix's receipt was valid.
