The Director had no locus to participate in the compulsory sale proceedings because her entitlement under the covenant was contractual and non‑proprietary and therefore was not a right affecting the lot within s.8 of the Ordinance; the Lands Tribunal had no jurisdiction to determine the Director's claim to a premium or to assess the EUV on that contractual basis, so the Tribunal should not have admitted or relied on the Director's evidence and the appeals by the Director are dismissed.
