Leave to adduce further evidence on appeal was refused because the defendant failed the first limb of Ladd v Marshall by not acting with reasonable diligence to obtain evidence available before the Master's hearing, much of the evidence adduced existed prior to the Hearing and the delays were inordinate and unjustified; only the post-decision payment evidence and one late police witness statement met the court's criteria and were permitted.
