The court refused to discharge the interim injunction but exercised its discretion to vary it: s213 empowers freezing to secure any penalty including criminal fines, and the commencement of criminal proceedings alone did not justify discharge; having considered disclosure and the defendant's changed financial position, the court ordered release of HK$10,000,000 from the frozen assets for payment of legal fees subject to the defendant's undertaking that the funds be used only for that purpose, and ordered the defendant to pay the SFC's costs of the application.
