On the balance of credibility the court found there was a telephone agreement on 16 February 1998 by which completion dates were extended to 30 June 1998 and the guarantor, Chan, agreed to extend his personal guarantee to that date; accordingly Chan was bound to repay the plaintiffs' deposits and judgment was entered for the plaintiffs against him.
