Defendants failed to discharge their duty to show good title and to answer reasonable requisitions prior to completion: faxed copies and undertakings were insufficient where originals/certified copies existed; registration of the Certificate of Compliance under Cap.219 had not been shown as at completion; unacknowledged amendments to the Assignment left a real doubt. Accordingly plaintiffs entitled to relief in originating summons and interlocutory judgment on damages.
