Although parts of the VRI were mistranslated and the judge made critical observations, the mistranslations did not materially prejudice the jury because the VRI was available to them, its deficiencies were apparent, the applicant's account was factually unclear and piecemeal, and on the whole the jury could and did determine the issue of knowledge for themselves; therefore the application to overturn the conviction was dismissed.
