The application was refused because it was brought at the eleventh hour in breach of an earlier order requiring leave for interlocutory applications, the explanation for lateness (quarantine) was insufficient and contradicted by the evidence, the witness is an important participant in events central to the dispute, and granting VCF would prejudice the Defendant and risk undermining the solemnity and fairness of trial; accordingly the court declined to entertain the application and refused it on grounds of lateness and prejudice.
