Even assuming there was a basis to suspect non-compliance with section 20A(2), the tribunal concluded on the statutory scheme (notably sections 20A(5) and (6)) that the appointment of the IO's solicitors could not be treated as void and was at most voidable; Ying Kong failed on all grounds of its amended summons and the application to vary the costs order was refused; the costs order nisi was made absolute and costs were awarded to the Applicant to be taxed on the District Court scale with a certificate for counsel, payable in any event rather than forthwith; indemnity costs were not awarded.
