The Tribunal dismissed the respondent's amended summons and refused to vary the costs order because it did not make a factual finding of s20A(2) non-compliance, and even assuming non-compliance the appointment of the IO's solicitors could be at most voidable under ss20A(5)-(7) so the respondent's grounds for striking out or stay were bound to fail; accordingly costs were awarded to the Applicant, to be taxed on the District Court scale with a certificate for counsel, with the costs order absolute and costs in any event rather than payable forthwith.
