The judge found no legal error in the Labour Tribunal's reasoning and that the factual findings were plainly supported by the evidence; accordingly the application for leave to appeal failed to meet the statutory/established threshold and was dismissed.

The application for leave to appeal is dismissed because the alleged errors relate to findings of fact and credibility, which are outside the statutory scope of appeal under s32(1) LTO, and any alleged failure to investigate MPF contributions did not create such injustice as to render the decision unsustainable; consequently there are no arguable points of law to permit an appeal.
