The magistrate properly concluded on the balance of probabilities that the appellant failed to prove ownership because the documentary evidence was unconvincing and key witness testimony was disbelieved; those credibility findings and the sufficiency assessment were open to the magistrate and the appellate court would not overturn them, therefore the forfeiture order under s.28(6) was correctly upheld.
