The trial judge properly weighed eyewitness, CCTV and expert reconstruction evidence and correctly concluded the appellant's continuous failure to observe the road and keep proper lookout amounted to dangerous driving causing death; the pedestrian's breach did not absolve the appellant and the sentence of 9 months' immediate imprisonment was within the appropriate range and properly mitigated.
