Although the magistrate erred in drawing adverse inferences from the appellant's silence at the post‑arrest record of interview, she had independently found the customs officers credible and accepted that the appellant made oral admissions at the scene; that independent finding was sufficient to sustain the convictions and no miscarriage of justice was shown, so the appeal was dismissed.
