The magistrate's acceptance of the police officers' evidence over the security guard's account was within her province as finder of fact given her advantage in seeing and hearing the witnesses, and there was no sufficient basis for the appellate court to overturn those credibility findings; therefore the appeal must be dismissed.

Conviction quashed because the Magistrate rejected part of PW2's evidence favourable to the appellant on the basis that PW2 was an accomplice, and it was impossible to be sure that acceptance of PW1's evidence and rejection of the appellant's evidence were not tainted by that rejection; therefore the conviction was unsafe and unsatisfactory.

The correct test is whether an amendment is one of substance; particulars fixing precise dates and reducing the amount from $2,000 to $1,000 were not substantive amendments, so no fresh Attorney General consent was required, the magistrate had jurisdiction, the confession statements were voluntary and admissible, and the magistrate's assessment of PW3 was reasonable; accordingly the convictions stand.
