Fast Trans's standard terms were incorporated by reasonable notice in the commercial context; Fast Trans was authorised by the Himalaya clause to contract on the plaintiff's behalf and to extend limitation benefits to the defendant; the relevant limitation clause in Fast Trans's contract (clause 13A) applied and was reasonable under Cap.71; the defendant is therefore entitled to rely on that limitation clause and the appeal is allowed.
