On the balance of probabilities the court preferred the plaintiff's account, found that an oral agreement was made whereby the defendant agreed to take responsibility for any civil claim if the plaintiff withdrew the insurer report, found defendant breached that agreement by failing to handle Ng's claim, found plaintiff acted reasonably to mitigate (including defending the claim and borrowing at high rates due to impecuniosity) and awarded damages of $947,954.38 plus costs, with interest to be determined on paper.
